NOTICE OF TRUSTEE'S SALE 70 acres, more or less, Rocky Mount Magisterial District, Franklin County (Tax Map 71-114) FRANKLIN COUNTY, VA In execution of a credit line deed of trust dated December 18, 2015 (the "Deed of Trust"), recorded in the Office of the Circuit Court of Franklin County, Virginia, in Deed Book 1071, Page 461, the undersigned substitute Trustees, any or all of whom may act, will offer for sale in front of the Franklin County Courthouse, 275 South Main Street, Rocky Mount, Virginia, on July 23, 2019, at 11:00 o'clock a.m., property located at or near Route 721, Rocky Mount, in Franklin County, Virginia, which property is more particularly described as follows: All that certain tract or parcel of land, situate in the Rocky Mount Magisterial District, Franklin County, Virginia, and more particularly described as follows, to-wit: Bearing Tax Map Identification No. 71-114 and being the same land conveyed to Leonard Hodges and Viola H. Hodges, husband and wife, by deed from Jeffrey Woody and Eva G. Woody, his wife, dated August 9, 1961, recorded in the Clerk's Office of the Circuit Court of Franklin County, Virginia, in Deed Book 188, page 171, and therein described as follows: "All that certain lot or parcel of land with all buildings thereon and appurtenances thereto belonging, lying and being on the east side of the public road leading from Doe Run to the old John Divers farm, in Rocky Mount Magisterial District, in Franklin County, Virginia, containing 70 acres, more or less, by the boundary, and lying adjoining the lands of M.D. Hutcheson, Albert Hodges, C. N. Parcell and the other land of Jeffrey Woody"; and LESS, HOWEVER, Lot 1 containing 2.229 acres and Lot 2 containing 0.954 acre as shown on survey of record in the aforesaid Clerk's Office in Deed Book 662, at Page 1263; and LESS, HOWEVER, that 1.000 acre conveyed in that deed of record in the aforesaid Clerk's Office in Deed Book 930, at Page 1064. This sale is subject to all liens, easements, restrictions, conditions, and reservations of record affecting the title to the property hereinabove described, to the extent any of them have priority over the lien of the Deed of Trust. TERMS OF SALE: Cash. A bidder's deposit of up to ten percent (10%) of the successful bid in cash or certified funds required. Settlement within fifteen (15) days of sale. Additional terms may be announced at the time of sale. The successful bidder will be required to execute a Memorandum of Trustee's Sale outlining additional terms of sale and settlement which will be available for review prior to the announcement of sale.
