Father charged after baby daughter found

A 7-week-old girl who was forcefully taken by her father early Wednesday morning in Franklin County was later found in Roanoke, authorities said.

James J. Austin and his girlfriend, April Foley, who is the baby's mother, had been arguing early Wednesday. Deputies were called to their apartment on Wrays Chapel Road near Rocky Mount about 4:30 a.m., said Lt. Steve McGuire of the Franklin County Sheriff's Office.

Foley decided to leave with the baby to stay at her mother's house in Ferrum, McGuire said.

Just before 6 a.m., Foley called the sheriff's office again. She told investigators Austin had come to the house and assaulted her mother, McGuire said. Then he grabbed his daughter by her arm and left with her in his car, which did not have a child car seat, McGuire said.

Foley also reported that Austin smelled of alcohol, McGuire said.

Later in the day, Franklin County deputies received information that Austin may have taken the infant to a relative's house in the 1800 block of Patterson Avenue Southwest in Roanoke. Officers went to the home and arrested Austin just after 1 p.m.

The baby was taken to Carilion Roanoke Memorial Hospital for an examination, though Franklin County Sheriff Ewell Hunt said she had no apparent injuries.

Austin, 21, was charged with driving on a suspended license and child neglect. He is also charged with assault and battery over the reported assault of the girl's grandmother.

Austin is being held at the Roanoke City Jail on a $2,000 bond.
