The estranged husband of a woman found fatally stabbed in South Roanoke on July 23 has been indicted on a charge of murder.
Heath Wayne Overstreet, 43, has been in custody since that day for apparently violating a protective order that his wife, Susan Overstreet, 45, sought after she said he attacked her in June. Susan Overstreet filed for divorce in early July and moved into an apartment on 24th Street.
A Roanoke grand jury returned the murder indictment Monday afternoon, according to Roanoke Commonwealth's Attorney Donald Caldwell.
"He faces the highest charge for which he's indicted, so it would be correct to say he's indicted for first-degree murder," Caldwell said.
Wayne Overstreet remains in the Roanoke City Jail without bond, and it was unclear Monday whether he had officially been served with the indictment and when he would be arraigned on the murder charge.
Caldwell said Susan Overstreet's apartment did not appear to have been broken into.
A search warrant filed in Roanoke Circuit Court on Monday showed that police sought two computers and three telephones from the Church Avenue branch of Valley Bank, where Susan Overstreet worked as a financial services representative. The warrant said that after their separation, the couple communicated primarily through e-mails and over her work phone.
Police previously searched the couple's home and took clothing, keys, a safe and a laptop. They also searched her apartment and took items that included a letter, a pair of glasses and strands of hair.
