Man gets 30 months over moonshine charges
John David Fralin, one of six people convicted last year of federal charges tied to a Franklin County-Halifax County moonshining operation, was sentenced Wednesday to 30 months in federal prison.
Fralin, who pleaded guilty in September to conspiracy and producing untaxed liquor, is the third defendant to be sentenced. U.S. District Court Judge James Turk said Fralin will be supervised by the federal probation office for two years after his release from prison.
His attorney, Chris Kowalczuk of Roanoke, said Fralin was a still hand in the operation.
The man that prosecutors said led the moonshine-making effort, Jody Alton Smith Sr., is scheduled for a post-trial motions hearing on Jan. 21, as is Margaret Smith, Jody Smith's one-time common-law wife. The Smiths were convicted of dozens of charges related to the operation.
Also scheduled to be back in court is Jarman Johnson, who will be sentenced Jan. 14 for unlawful production of spirits and violating the Travel Act to produce and receive liquor.
The two defendants already sentenced are Danny Walter Davis, who received two years' probation for conspiracy and money laundering, and Terry Lynn Smith, who got 21 months in prison and two years of supervised release for conspiracy and producing untaxed liquor.
