Roanoke grand jury charges man with murder
Officials sought a new indictment following the death of a homeless man, who had been badly beaten.
A Roanoke grand jury charged a homeless man with murder Monday related to a brutal beating that eventually resulted in another homeless man's death.
Justin Matthew Michels, 23, originally was charged with malicious wounding in relation to the July 15 beating. Police arrived at 12:26 a.m. in the first block of Norfolk Avenue Southwest to find David Lee Thompson, 40, critically injured. Michels was arrested later that morning. He is being held without bond in Roanoke City Jail.
Thompson was taken to Carilion Roanoke Memorial Hospital, where he died July 24. He had been beaten with a cinder block, said Assistant Roanoke Commonwealth's Attorney Andrew Stephens.
Now that the grand jury has returned a murder indictment, the malicious wounding charge will be dropped, Stephens said.
Thompson had stayed recently at the Rescue Mission of Roanoke and was well-known there. The evening before the attack, he had dinner at the shelter, but left before the chapel service began.
In other actions, the Roanoke grand jury indicted a Roanoke man on a charge of rape for an incident that happened Aug. 26.
Martin Lee Whorley, 39, was at a gathering with a relative and a married female acquaintance. The alleged assault took place after Martin asked the woman to leave the gathering to help him look for the relative, said Deputy Roanoke Commonwealth's Attorney Betty Jo Anthony.
In other grand jury news, a Botetourt County grand jury on Monday indicted a 20-year-old man for rape and animate object sexual penetration related to an alleged sexual assault on a 5-year-old girl. The girl is the man's brother's stepdaughter, said Deputy Botetourt County Commonwealth's Attorney Hillary Griffith.
