Manslaughter charge goes to grand jury
Keith Dean Quesenberry, 22, is charged with voluntary manslaughter in the death of 23-year-old Michael Andrew Quesenberry.
The pair struggled before Michael Quesenberry was found unresponsive outside a home on Moose Drive early the morning of Sept. 5, Christiansburg police have said.
Keith Quesenberry was first charged with assault and battery, but the charge was upgraded to voluntary manslaughter after a medical examiner found that Michael Quesenberry died of injuries he suffered in an altercation.
According to a search warrant affidavit filed in Montgomery County Circuit Court, a witness reported seeing Keith Quesenberry with his arm around Michael Quesenberry's throat.
Keith Quesenberry's brother pulled him off Michael Quesenberry and administered CPR, according to testimony at a bond hearing last month.
Keith Quesenberry was granted bond at that hearing but ordered not to have any contact with any witnesses, including Michael Quesenberry's parents or fiancee.
He appeared in Montgomery County General District Court on Friday.
No evidence was presented at the hearing. Instead, Keith Quesenberry's attorney, Jimmy Turk, stipulated that there was enough evidence to certify the manslaughter charge to a grand jury, which will decide whether Keith Quesenberry should face a trial in circuit court.
Also at Friday's hearing, the assault and battery charge against Keith Quesenberry was officially dropped.
He pleaded not guilty to a charge of public intoxication stemming from the same incident, but stipulated that there was sufficient evidence for a finding of guilt on that charge.
General District Court Judge Randal Duncan found him guilty and fined him $25.
