No charges filed in death of cyclist at Virginia Tech

There is no evidence that the driver of the truck that collided with a cyclist was at fault, police say.

Investigators have determined that the driver of a dump truck that collided with a bicyclist on Virginia Tech's campus last month was not at fault.

The bicyclist, 61-year-old Bonnie Tinker of Portland, Ore., died at the scene of the crash that happened about 4:30 p.m. July 2.

According to a news release Thursday from Virginia Tech Police Chief Wendell Flinchum, the truck and the bike were both headed north on West Campus Drive. Based on witness statements and evidence, the truck was in the proper lane and the bike was next to the truck in a bike lane when it began to wobble and "became entangled" in the truck's rear wheels. The truck then made a right turn onto Drillfield Drive.

The truck's driver, who has been identified as Paul Bandy, didn't immediately know the incident had happened. A bystander got his attention and he stopped, Flinchum said.

There is no evidence indicating that Bandy's actions contributed to the crash, he said.

Montgomery County Commonwealth's Attorney Brad Finch, after reviewing the evidence and witness statements, determined that no charges will be filed, Flinchum said.

Tinker was wearing a helmet, he said.

Flinchum said the New River Valley Regional Crash Investigation Team, which includes officers from the Virginia Tech, Christiansburg, Blacksburg and Radford police departments and the Montgomery County Sheriff's Office, investigated the crash and the Virginia State Police Motor Carrier Unit examined the truck.

The dump truck, owned by William G. Simmons Co. of Narrows, was contracted by the university, Tech spokesman Larry Hincker has said. It was hauling fill dirt from an area near Lane Stadium to a site close to Schultz Dining Hall.

Tinker was on campus with the Religious Society of Friends, who were using university facilities for a Friends General Conference.

An activist who focused mainly on gay and lesbian family issues, Tinker was the executive director of Love Makes a Family. She also was a member of the Seriously Pissed Off Grannies, a group that opposes the war in Iraq.
