Jury still at stalemate in capital murder trial

After a full day of meeting to discuss whether James Jones II killed and robbed Ken Henry, a Radford jury left Thursday looking frustrated.

Several of the eight women and four men had their arms crossed or their hands in their pockets as they filed out of the jury room in Radford Circuit Court at 5 p.m. Thursday. They had been in the room since 8:30 a.m. and had met there for a couple of hours the day before, after hearing closing arguments from the prosecution and the defense.

Jones, 24, is charged with capital murder and other crimes in connection with the fatal shooting of Henry on July 5, 2006. A neighbor called 911 after Henry, 39, was seen bleeding and yelling for help in the parking lot of the Davis Street apartment building where Jones' then-fiancee, Kelly McKenzie Brubeck, lived.

Brubeck at first told police she shot Henry after he tried to rob her. She later said Jones shot him to rob him of money and drugs.

Jurors listened to five days of testimony in the case, including testimony from Brubeck and Jones. Each says the other shot Henry.

Brubeck is charged with second-degree murder in the case. A trial date for her has not been set.

If the jury convicts Jones of any of the five charges he faces, it will meet again to discuss what sentence he should receive. Capital murder is punishable only by life in prison or the death penalty.

The jury will reconvene at 8:30 this morning.
