Radford University's Amir Johnson enters Alford plea to misdemeanor charge
The point guard who helped lead Radford University into the NCAA men's basketball tournament was convicted of petit larceny, a misdemeanor, this afternoon.
Amir Johnson, 21, had been charged with burglary and grand larceny, a felony. According to indictments handed up by a Radford grand jury that met June 12, Johnson had been charged with breaking and entering into the home of ex-teammates Martell McDuffy and Jamar Jenkins on May 5.
Johnson's lawyer, Jimmy Turk, has said Johnson is accused of taking a PlayStation, some software for the PlayStation and an iPod.
This afternoon in Radford Circuit Court, Commonwealth's Attorney Chris Rehak dropped the burglary charge and amended the felony larceny charge to a misdemeanor. Johnson then entered an Alford plea to the misdemeanor. The plea acknowledges there is enough evidence to convict but allows a defendant to maintain his innocence.
Circuit Judge Joey Showalter convicted Johnson of the misdemeanor charge and sentenced him to 12 months in jail, all suspended. Johnson will spend 12 months on probation and must pay a $500 fine. He has already paid $500 in restitution to Jenkins and $1,000 to McDuffy.
In a written statement, Rehak said: "Securing a conviction with probation and restitution appropriately reflects the evidence, defendant’s conduct and the wishes of both victims. The plea agreement enabled defendant to avoid the possibility of felony convictions while still requiring accountability and consequences."
