Judge certifies charges in Wythe County homicide case

All but one of the charges against a Wythe County man accused of killing one neighbor, shooting and injuring another and trying to kill three other people are moving forward.

At a closed hearing this morning in Wythe County Juvenile and Domestic Relations Court, Judge Lee Chitwood certified to a grand jury 12 of the 13 charges against Douglas Albert Jaccard of Max Meadows.

The grand jury, which meets next month, will decide whether Jaccard should face a trial in circuit court.

Police say Jaccard, 59, shot and killed neighbor Joe Bane on the lawn of Bane’s Dyer Road home, shot neighbor Jerry Covey in the arm and set fire to Bane’s house with Bane’s wife and son still inside.

The events sparked a three-day manhunt for Jaccard in mid-December, during which police say he also shot at them.
Jaccard was found hiding under his kitchen table. Police have said they think he went back to his house to retrieve some items.

Jaccard is charged with first-degree murder in Bane’s killing and with malicious wounding in Covey’s shooting.

He is also charged with the attempted capital murder of Pulaski County Deputy J.A. Radcliffe and Wythe County Deputy R.C. Coleman, the attempted first-degree murder of Bane’s son, five counts of using a firearm in the commission of a felony, possession of a firearm by a violent convicted felon and statutory burglary during the day with a deadly weapon.

Jaccard was also charged with arson, but Chitwood did not find probable cause to certify that charge to a grand jury Tuesday.However, Wythe County Commonwealth’s Attorney Gerald Mabe could choose to seek a direct indictment from the grand jury on the arson charge. He said this afternoon he hasn’t decided yet whether to do that.
