Richmond lawyer apparent pick for Western District U.S. attorney

The president’s pick for U.S. attorney for the Western District of Virginia apparently will be University of Virginia law professor and Richmond lawyer Timothy Heaphy.

Heaphy, who works for McGuire Woods in Richmond and teaches federal criminal practice in Charlottesville, said today that he could not comment on the selection process. But the two other candidates nominated by Virginia Sens. Jim Webb and Mark Warner have been notified that they are not President Obama’s choice for the position.

Assistant U.S. Attorney Tom Bondurant said this evening that he had heard from Webb’s office that another candidate had been chosen.

Similarly, the Martinsville Bulletin reported Tuesday that Martinsville Commonwealth’s Attorney Joan Ziglar said she’d received word from Webb’s office that she would not be the U.S. attorney. Ziglar could not be contacted this evening.

Heaphy’s career includes stints as an assistant U.S. attorney in Washington, D.C., from 1994 to 2003 and in the Western District of Virginia’s Charlottesville office from 2003 to 2005.

U.S. attorneys are the top federal prosecutors for their districts. They are appointed by the president and their appointments are confirmed by the U.S. Senate.
