I think they should do away with all these plea agreements and if someone kills someone they either get life in prinson or the death penalty like Mr.Smith should have got.

I think Mr.Smith should had never been release from prinson.Killing two people and just serving the time that he did wasn't justice. He should had got the death penalty.

Interesting, ATHiker - I assume you are intimately familiar with the facts, and whether the evidence was strong enough to get a conviction at trial as opposed to accepting a guilty plea to a lesser included offense so that the community was safe for at least 15 years that this guy was behind bars? Anyone can play Monday morning quarterback, but taking a shot at the prosecutor, now deceased, about what decisions were made 20 some years ago with a paucity of evidence is pretty lame. Remember, all the defense would have to show is reasonable doubt and the guy walks scot free.

Good call o_c.

Scandels, the judges are bound by the laws, they don't make them. This guy killed two people 20+ years ago, but for whatever reason was not convicted of 1st degree murder. I wish I could remember why, but he only got 15 or 16 years. If you go through life comparing sentences and crimes, you'll make yourself nuts. Sometimes the judicial system is anything but juducial.

Justafan, yep it sounds like this is the guy all right. Still requires due process.
Scandals, my friend, perhaps we should remind you that in fact it is juries, not judges, who decide guilt or innocence in these cases.

Judges are some of the most "brilliant" and "educated" people in our society. I think that should be a good barometer of where higher education is in America today. Bassackwards. Folks with Phd's who can't even manage there personal lives. Shrienks who see shrienks.
Knowledge is not wisdom. Many are knowing fools and be greater fools the more they learn. Wisdom is the right use of knowledge.
There should be a practical litness test for judges. They should have to be competent in these things before they can get into law school:
How to change the oil in a car.
How to say I'm sorry and mean it.
How to use a tape measure.
How to clean and cook a dead squirrel.
How to have sex with the opposite sex.
And a few more I can't think of now.

Let the evidence convict him and let the trial take it's course, but let's take a look at how many folks who kill multiple people and get out of jail eventually kill again.
Why should we ever release people from prison who kill multiple victims? I can see if a teenager makes a mistake and pays for it most of his life getting out of prison when they are 60, but come on, we live in a backwards society when you get less time in prison for killing someone than for dealing marijuana.
I've got an idea, let's vote for more liberals so no one ever goes to prison, except for eating meat and driving a big car. I mean after all, those are the real criminals.

I agree Nancy was coming across a bit harsh and sometimes people are wrongfully accused. However, Considering this guys track record, the location of the crime, the fact he was seen in the area and the fact that they caught him after he wrecked in of the victims stolen vehicles, and the fact that the victims can I.D. him, I think maybe they have the right guy in this case. But he still has the write to a fair trial.

Not so fast, please. The police have a pretty spotty record when it comes to nabbing the right person. So why don't we all just wait for the trial, hmm? If he is found guilty, the death penalty certainly seems justified.
